8th circuit (just barely) says shackles during labor violate 8th amendment

Last week, the 8th Circuit handed down Nelson v. Norris, which found that a woman's constitutional rights were violated when her legs were shackled to her bed during labor. True. In a six-to-five en banc decision, the Eighth Circuit held that this was a constitutional violation and that the guard was not entitled to qualified immunity.
